Homologation Procedure in Switzerland : ABE – ECE – CH Approval – Capristo Exhaust System – Gutachten – Abgasanlage

1. Introduction

Modifying an exhaust system in Switzerland requires adherence to strict standards to ensure road safety, environmental compliance, and noise level regulations. This detailed product sheet provides technical specifications, required certifications, and the homologation process, including Swiss-compliant figures for each step.

2. Required Certifications: ABE – ECE – CH Approval – Capristo Exhaust System – Gutachten – Abgasanlage

To homologate an exhaust system, the following certifications are necessary to ensure compliance with Swiss and European standards:

  • Teilegutachten:
    • Description: A certificate issued in Germany confirming that the part complies with EU directives.
    • Requirements: The part must comply with European Directive 97/24/EC (modification of exhaust systems). In Switzerland, this certificate must be validated for local specifics.
  • DTC Certificate (Dynamic Test Center AG):
    • Institution: Dynamic Test Center AG, accredited by OFROU (Swiss Federal Roads Office).
    • Content: Confirms that the exhaust system meets Swiss standards.
      • Noise Level: Maximum of 80 dB(A) measured at 3/4 of the engine’s maximum speed for light vehicles.
      • Emissions: Pollutant concentrations (CO, HC, NOx) must comply with limits set by the Ordinance on Air Protection (OPair), such as:
        • CO: Maximum 1.0 g/km for gasoline vehicles.
        • NOx: Maximum 0.2 g/km for diesel vehicles.
  • FAKT AG Certificate:
    • Institution: FAKT AG, accredited by OFROU.
    • Evaluation:
      • Durability: Resistance test simulating 100,000 km of operation with climatic variations from -20°C to +40°C.
      • Performance: Emissions must not exceed the original values by more than 5%.
  • ECE Certificate (Economic Commission for Europe):
    • Description: United Nations certificate for European standards.
    • Compliance: The system must meet European ECE R-59 standards for noise (maximum of 74 dB(A) at 3/4 of the engine’s maximum speed) and emissions.

3. Homologation Process : ABE – ECE – CH Approval – Capristo Exhaust System – Gutachten – Abgasanlage

To homologate a modified exhaust system, follow these steps:

  1. Preparation and Installation:
    • Professional Installation: Ensure that the system is installed by an accredited professional to guarantee compliance with technical specifications.
  2. Testing and Inspections:
    • Emission Analysis:
      • Test Bench: Conduct tests on a test bench certified according to Swiss standards.
      • Requirements:
        • CO: Maximum 1.0 g/km.
        • HC: Maximum 0.1 g/km for gasoline vehicles.
        • NOx: Maximum 0.2 g/km for diesel vehicles.
    • Acoustic Test:
      • Methodology: Measurements conducted with a microphone placed 0.5 meters from the vehicle under various conditions.
      • Limits: Maximum noise level of 80 dB(A) measured at 3/4 of the engine’s maximum speed for light vehicles.
    • Visual and Mechanical Inspection:
      • Verification: Ensure correct installation, airtight seals, and absence of leaks.
  3. Obtaining Certificates:
    • Teilegutachten: Obtain this certificate and validate it for Switzerland.

Switzerland (CH): Proof of Purchase

Switzerland (CH): Proof of Purchase

1. Documentation Requirements

In accordance with the provisions of the Swiss Code of Obligations (CO), specifically Articles 31 to 40 pertaining to sales contracts, and the Federal Act on the Protection of Trademarks and Indications of Source (LPM, RS 232.11), we impose stringent criteria concerning the “proof of purchase.” This document is essential to ensure that products are acquired directly through our authorized store, are accompanied by the required certification, and comply with the quality and safety standards established by Swiss regulations.

2. Verification and Exclusions

The “proof of purchase” is required to confirm the traceability and provenance of products in compliance with Articles 41 and 43 CO regarding the seller’s obligations and warranty. Products lacking this documentation, including those obtained through unauthorized distribution channels, bulk sales of inferior quality, or without a valid purchase invoice, will be systematically rejected. Additionally, pursuant to Article 3 of the Federal Act on the Protection of Trademarks (LPM, RS 232.11), replica, counterfeit, or non-authentic products are strictly excluded from our offering.

3. Additional Documentation and Supplementary Fees

For products lacking a “proof of purchase,” additional documentation requirements may be imposed, such as providing further evidence of provenance and compliance. These additional verification procedures may incur supplementary fees to cover the administrative and validation costs, as stipulated by the Federal Supreme Court decision 4A_108/2014, which addresses the costs of verification and administrative processing.

4. Right of Refusal and Reporting

We reserve the right to refuse any certificate of conformity request without obligation to provide justification, in accordance with the discretionary powers established by the Federal Supreme Court decision 4A_174/2015. Furthermore, any attempt at fraud or suspicion of counterfeiting will be reported to the competent authorities in Switzerland (CH), as per Articles 9 and 10 of the Federal Act against Unfair Competition (LCD, RS 241) and the Federal Act on Customs (LD, RS 631.0).

5. Responsibilities and Recourse

Clients may challenge decisions related to “proof of purchase” or documentation requirements by submitting a request for review or clarification. These requests will be handled with diligence in accordance with the principles of transparency and fairness outlined in the Federal Act on Administrative Procedure (LPGA, RS 172.021) and the Federal Supreme Court decisions, such as case 2C_129/2019.

We appreciate your understanding and cooperation in adhering to these strict requirements. For any questions or requests for clarification regarding our compliance and purchase validation procedures, our specialized team remains at your disposal
